These terms are an agreement between you and [Registered business name] (“we”, “us”), which runs GetAPlot. By signing in or using the site you accept them. If you do not agree, please do not use GetAPlot.
1. What we do, and what we do not
GetAPlot is a notice board where property owners and agents list properties and people looking for a property find them. We are an intermediary: we do not own, sell, rent or arrange any listed property, we are not a party to any deal, and we do not set or negotiate prices.
- Listings are posted by users. We do not guarantee that a listing is accurate, available, lawfully owned or free of disputes.
- We do not verify listings, owners, titles, approvals or prices.
- Always visit the property, see the original documents and check ownership, approvals and dues yourself, and use a lawyer for any purchase or lease.
- Never pay a token or advance to anyone before you have seen the property and the papers.
- We, and anyone acting for us, will never ask you for your password, a sign-in code, a card or UPI PIN, or an advance for a listing. Anyone who does is not us: do not pay, and report them to [support email address].
2. Owners, agents and projects
- Owners and agents can both list, and everyone is treated the same. If you list as an agent, say so in the listing. You are responsible for your dealings with buyers and tenants, including any brokerage you charge and any tax on it.
- If a listing is for a project, plot layout or building that the law requires to be registered under RERA (the Real Estate (Regulation and Development) Act, 2016), you must hold a valid registration and show the number in the listing. We may ask for proof, and we may remove listings that cannot show it.
- Sale and lease terms, agreement to sell, stamp duty, registration and any local approvals are between the parties. We do not draft, hold or witness any of them.
3. Who can use it
You must be 18 or older and able to enter a binding contract in India. You need a mobile number you control to create an account.
4. Your account
- You sign in with your mobile number and a password. The first time, we send a one-time code by SMS to confirm the number.
- Keep your password private. You are responsible for what is done through your account. Tell us at once if you think someone else has used it.
- One person, one account. Do not create accounts or use other numbers to get around the limits in these terms.
- You can change your name, password and mobile number in your account, and delete the account at any time. Changing the number needs a code sent to the new number.
5. Posting listings
- Your first 2 listings are free and stay live for 90 days each (counted per account and per contact number). See section 6 for what comes after.
- Post only properties you own or are authorised to list. Give true, current details: price, area, location, photos and availability. Close the listing once it is sold or let.
- Do not put phone numbers, e-mail addresses, links, or messaging handles (for example WhatsApp or Telegram) in titles, descriptions, addresses, names or photos. Buyers get your contact number by unlocking your listing, and that is how we keep posting free. Listings that try to get around this can be removed.
- The map pin you drop is shown to everyone rounded to about 10 metres. A plot outline you draw is shown as drawn.
- Photos must be of the property and yours to use. They must not contain contact details, watermarks of other sites, or other people’s personal information.
- You give us a non-exclusive, free right to store, show, resize and promote your listing content on and for the site while it is live. You keep ownership of it.
6. Paying for listing time
- Every account gets 2 free listings, each live for 90 days. After that a free listing is hidden (not deleted) and stops counting toward the 2 free ones. You can renew it at any time.
- Any listing beyond the free ones costs ₹1 a day. Posting one buys a minimum of 60 days (₹60), paid before it goes live, and you can add more time in blocks of 30 days (₹30 each).
- Renewing any listing, live or hidden, is done in blocks of 30 days. The days are added on top of any time you have left. A listing that runs out of time is hidden, not deleted, and goes live again as soon as you renew.
- Card, net-banking, wallet and pay-later payments carry the gateway charge described in section 7, shown before you pay.
- Time you have bought is not refundable, including when you close or delete a listing early, except where you were charged and the time was not added (for example a technical fault, or a duplicate charge). Write to us within 7 days with the payment reference.
- No GST is added to our prices today because we are not yet registered for it. If and when we register, GST will be added and shown before you pay.
7. Unlocking an owner’s number
- Seeing an owner’s full mobile number costs ₹20 per listing, paid once, when you pay by UPI. Taxes are added if and when they apply.
- If you pay by card, net banking, wallet or pay-later instead of UPI, a payment gateway charge of 2.36% is added to the price (currently ₹0.47, so ₹20.47 in total for one number). This charge is billed by the payment company, not kept by us. You are shown the exact amount for each way of paying, and nothing else is added after you confirm.
- The same applies to any other payment on the site, such as listing time: the listed price is the UPI price, and card, net-banking and wallet payments carry the gateway charge shown before you pay.
- Payments are handled by Cashfree. We never see or store your card, UPI or bank details.
- An unlocked number stays in “My contacts” for as long as the listing and your account exist.
- Because the number is shown the moment you pay, the ₹20 is not refundable, except where you were charged and the number was not shown to you (for example a technical fault, or a duplicate charge). In that case write to [support email address] within 7 days with the payment reference, and we will refund it to the original payment method.
- Use numbers you unlock only to talk to the owner about that property. Do not use them for marketing, calling people who are on a Do Not Disturb list, passing on to others, or harassment.
8. Things you must not do
- Post fake, misleading, duplicate or already-sold listings, or listings for illegal or disputed property.
- Pretend to be someone else, or collect advance money or personal information under false pretences.
- Scrape, copy or resell listings or numbers in bulk, probe or attack the site, or try to get around limits, rate controls or payment.
- Upload malware, or content that is unlawful, defamatory, obscene, or infringes someone’s rights.
- Use the site for anything other than genuine property search and listing.
We may remove content, limit features, or suspend or end accounts that break these terms or the law, with or without notice where needed to protect users or the site.
9. Reporting a listing, and what we do about it
- If a listing looks fake, sold, wrongly priced, unlawful or infringes your rights, tell us at [grievance email address] with the listing link and what is wrong. We look at reports promptly.
- We remove or disable content that is unlawful, or that a court or an authorised government agency tells us to remove, within the time the law allows. We may also remove content that breaks these terms.
- If we remove your content or restrict your account, we will usually tell you why and you can reply to the Grievance Officer. Repeated or serious breaches can lead to the account being ended.
10. Messages and calls
We send SMS only for sign-in codes and important account notices. We do not send promotional messages. Owners and buyers who contact each other after an unlock do so on their own, and each is responsible for how they use the other’s number (see section 7).
11. Shortlist and compare
You can shortlist listings (kept in your account) and compare up to four side by side (kept in your browser). These are conveniences. A listing you saved can disappear if the owner closes or deletes it, or if its owner deletes their account.
12. Deleting your account
If you delete your account, we erase it and what is attached to it, including your listings and photos, and the unlocks, saved contacts and shortlist entries that other people hold for your listings. Details, and the one thing we must keep (anonymous payment records), are in the Privacy Policy. Deletion is permanent.
13. Disclaimers and limits on our liability
- GetAPlot and its content are provided “as is” and “as available”. We do not promise that the site will always work or be error-free.
- We are not responsible for what users post, for any deal, payment, visit or dispute between users, or for decisions you make using listings or the comparison tools.
- To the extent the law allows, our total liability to you for any claim about the site is limited to the amount you paid us in the 12 months before the claim (and to nothing for free use). We are not liable for indirect or consequential loss, such as lost deals or profit.
- Nothing here limits a right you have under law that cannot be limited, including consumer rights.
14. Our content, other sites and events outside our control
- The GetAPlot name, logo, design and software belong to us or our licensors. You may not copy or reuse them, or build a competing listing service from our data, without written permission.
- The site may link to or load services from others (for example maps and payments). We do not control them and their own terms apply to them.
- We are not liable for delay or failure caused by things outside our reasonable control, such as network or power failures, failures of providers we depend on, natural events, strikes, or government orders.
15. Ending the agreement
You can stop at any time by deleting your account. We can suspend or end your access if you break these terms or the law. Sections that by their nature should continue (for example the payment, content, liability and law clauses) continue after the account ends.
16. Changes and general
- We may update these terms. The date at the top shows the latest version. If a change matters, we will tell signed-in users on the site. Using the site after a change means you accept it.
- If a part of these terms is found invalid, the rest still applies. Not enforcing a clause at once does not give up our right to enforce it later.
- These terms, with the Privacy Policy, are the whole agreement between you and us about the site. You may not transfer your account or rights to someone else. We may notify you through the site or by SMS to your number.
17. Law, disputes and contact
These terms are governed by the laws of India. Courts at [City], India have jurisdiction, subject to any right you have to go to a consumer forum near you. Please write to us first at [support email address] and we will try to settle it quickly.
Complaints about content or how we handle your data: Grievance Officer, [Grievance Officer name], [grievance email address], [Registered business name], [Registered office address]. We acknowledge complaints within 24 hours and aim to resolve them within 15 days.
